Barry County Republican Party Resolution Calling for the repeal or making voluntary the “Time of Sale or Transfer” regulation of the Barry Eaton District Health Department.
Whereas we believe that personal property rights are a corner stone of American Freedom and
Whereas the rural residents of Barry County can no longer sell their property without an authorization or permission from the Barry Eaton District Health Department and
Whereas the “Time Of Sale or Transfer” was imposed on the rural residents of Barry County which account for over 70% of the population of Barry County and
Whereas no baseline study was performed to indicate that onsite septic or well systems were contaminating the watersheds of Barry County and
Whereas no study has been performed to indicate the watershed quality has improved since the imposition of said regulation and
Whereas the application of said regulation has morphed beyond the scope that was presented to the Barry County Board of Commissioners and
Whereas there is no over-site of the regulation by elected officials and modification of the regulation rests only with the Health Officer of the Barry Eaton District Health Department and
Whereas the application of the regulation has been inconsistent and arbitrary and
Whereas the imposition of the regulation has cost the rural residents of Barry County up to $2,000,000 for mandated evaluations. This does not include the cost of permits nor the cost of mandated repairs, Therefore
Be it resolved that the Executive Committee of the Barry County Republican Party demands that the Barry County Board of Commissioners take the necessary steps to rescind the TOST regulation or in the alternative make it a voluntary process between Buyer and Seller.
